Terms of Service

These terms are an agreement between you and Forecheck AI, LLC, an Arizona limited liability company ("Forecheck," "we," "us"), which makes Locker Room Fund, the software at lockerroomfund.com (the "Service"). By signing in, joining a pool or otherwise using the Service, you agree to these terms. If you don't agree, don't use the Service.

Section 12 requires you to resolve disputes with us through binding individual arbitration, not a jury trial or class action, unless you opt out within 30 days.

1. What Locker Room Fund is

Locker Room Fund is software that youth sports teams and similar groups (each a "Team") use to run season-long football games ("pools") with their families and supporters. The Service keeps entries, picks, deadlines, scores and standings, and sends emails about them. We do not run any pool, set its rules or prizes, collect or hold money, pay prizes or decide who wins outside the rules a Team sets in the Service.

2. Who can use it

You must be at least 21 years old to join a pool or make picks. An adult who plays for someone in their household (for example, a child) is the participant for every entry they manage and is responsible for it under these terms. One person per account. You sign in with a one-time code sent to your email, so keep your email account secure; you are responsible for what happens under your sign-in.

3. Teams run their pools

Each pool is run by its Team. The Team decides its rules, prices and prizes; collects, holds and refunds every payment; confirms payments in the Service; pays prizes; answers questions and resolves disputes about its pool; handles any taxes; and is responsible for making sure its pool is allowed where it and its players are and by the payment providers it uses. Any payment you make goes directly to the Team (for example by a payment app, a bank transfer, cash or the Team's own donation or ticketing page). Forecheck is not a party to any arrangement between you and a Team, never receives, holds, moves or verifies your money, and charges you nothing. Questions about money or prizes go to your Team's admins.

4. How pools work in the Service

Each pool's Rules tab shows how it works, including deadlines, tiebreaks, how ties are split, and what happens when you miss a deadline (for example, random picks drawn once and never redrawn). A payment counts only as the pool's rules say. A Team admin's confirmation of a payment, and the results the Service records under the pool's rules, are final, except where the Team corrects a clear error.

5. Scores and accuracy

Scores and schedules come from public sports data sources and can be late, wrong or changed. The Service may correct results when the source is corrected. Live totals during games are for display only. We do our best to keep the Service running, but it can be unavailable, slow or wrong, and we don't promise any particular result, uptime or delivery of any email.

6. Payments, prizes and taxes

All payments and prizes are between you and the Team. Payments for a chance to win prizes are generally not tax-deductible, and we make no tax statements. Unclaimed prizes are handled by the Team's rules.

7. What others see

Anyone with a pool's link can see the pool's standings and, after each deadline, everyone's picks, with each player shown by first name and last initial. Team admins see your full name, email, phone number, any payment app username you add, and payment records for their Team. Our Privacy Policy explains what we collect and how we use it.

8. Your conduct

Don't give false information, pretend to be someone else, use automated tools to access the Service, interfere with or probe its security, harass anyone, or use the Service for anything unlawful. We may suspend or remove access, entries or pools that break these terms or that appear unlawful or abusive.

9. Names and trademarks

Locker Room Fund is not affiliated with or endorsed by the National Football League or any NFL team. Team names are used only to identify the teams in real games. Other names and logos belong to their owners.

10. No warranties

The Service is provided "as is" and "as available." To the fullest extent the law allows, Forecheck disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement.

11. Limits on liability

To the fullest extent the law allows, Forecheck and its members, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost money, prizes, data or opportunities, arising from the Service or any pool. Our total liability for any claim is limited to the greater of $100 or the amount you paid Forecheck in the 12 months before the claim (Forecheck charges players nothing).

You agree to cover Forecheck for claims, losses and costs (including reasonable attorneys' fees) that come from your breaking these terms or the law, or from your dealings with a Team or other players.

12. Disputes and arbitration

If you have a problem with the Service, contact us first at info@forecheckai.com and we'll try to resolve it within 30 days. If we can't, you and Forecheck agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us may instead bring an individual claim in small claims court. Neither of us may bring or join a class, collective or representative action. The arbitrator decides any question about this section. You may opt out of arbitration by emailing us at info@forecheckai.com within 30 days after you first accept these terms, with your name, email and a statement that you opt out.

These terms are governed by Arizona law, without regard to its conflict-of-laws rules. Any dispute not sent to arbitration or small claims court will be heard only in the state or federal courts in Maricopa County, Arizona, and you and Forecheck consent to their jurisdiction.

13. Changes and ending

We may change these terms. We'll post the new version here with a new date and, for material changes, ask you to accept them in the Service or tell you by email before they take effect. You may stop using the Service at any time. We may suspend or end the Service, or your access, at any time. Sections 3, 6 and 9 to 12 continue after that.

14. The rest

These terms, the Privacy Policy and each pool's Rules are the whole agreement between you and Forecheck about the Service. If a part of these terms can't be enforced, the rest still applies. Our not enforcing a term isn't a waiver. You can't transfer these terms; we may transfer them to a company that takes over the Service.
